General Data Protection Regulation

The Brazilian General Data Protection Law (Law 13.709 / 2018) aims to ensure the right to privacy and protection of users’ personal data. The LGPD (Lei Geral de Proteção de Dados) creates a new scenario of personal and legal security, standardizes the practices and rules for the protection of the personal data of all individuals residing in Brazil, collected electronically or physically.

Considering the next Consumer Protection Code, all companies must be in conformity to LGPD, under penalty of administrative and court penalty. Companies not in accordance with the law may have in addition to penalty, the loss of the possibility of data collection.

At Contesini e Advogados Associados, we implemented the LGPD in data collection companies and operators, applying governance and compliance standards so the damage is mitigated in the event of any data leakage. We also cover the interests of individuals who have their data collected. Through administrative and legal consultancy, we point out the non-conformities with the legislation and present solutions to these inconsistencies in the legislation.
